Mr. Winsberg recently defended a Petition for Protection from Abuse filed in St. John Parish. He represented a father accused of choking, hitting, and throwing his child. Through dogged cross-examination of the mother, who brought the claim, Mr. Winsberg cast serious doubt on her story. After a day-long trial, the judge dismissed the petition due to the many inconsistencies in the testimony.

Mr. Winsberg recently won an appeal of a spousal abuse case that he had previously prevailed upon in the trial court. He represented an ex-husband accused of several acts of abusing his ex-wife. After a multi-day trial, the trial judge dismissed all claims with prejudice. After extensive briefing and oral argument on the wife’s appeal, the Fourth Circuit Court of Appeal affirmed the trial court’s decision.

Mr. Winsberg and Ms. Heidingsfelder successfully defended a mother against a child abuse claim made by the father, who accused her of physically assaulting their young daughter. During the trial, testimony was provided by both parties and the child’s therapist. After considering the evidence, the judge dismissed the father’s case with prejudice.

Marc Winsberg achieved a notable victory in a hard-fought relocation trial held in Plaquemines Parish. Acting on behalf of a dedicated Navy Lieutenant and loving mother, he successfully defended her right to relocate to Virginia due to a transfer ordered by the Navy. Despite opposition from the father, who sought to keep their 20-month-old daughter in the local area, the judge ultimately ruled in favor of the mother – granting permission for the relocation.

The wife appealed, claiming that the husband did not adequately prove the adultery. The three judges on the court of appeal panel disagreed, finding that the husband proved the adultery and was entitled to the adultery divorce.
